Terms of Use & Disclaimer
All information and product supply takes place under OrientalPharma.com terms and conditions, herein referred to as OrientalPharma. The end user / importer is referred to as the buyer.
1. OrientalPharma will only supply products under these terms and conditions, which are final.
2. The buyer confirms they are of legal age.
3. OrientalPharma reserves the right to alter methods of shipments or to refuse orders as we see fit.
4. The buyer agrees that they have valid prescriptions from their physician before making any order. The buyer accepts full liability for the use of all products and services supplied by OrientalPharma. The buyer vows they will only use products under the guidance of their physician.
5. The buyer is completely responsible for the confirmation of their personal importation requirements. Products are not available where prohibited by law.
6. The buyer makes a solemn pledge that they hold OrientalPharma free of any and all legal action and prosecution. This includes any entrapment procedures that may be perpetrated by law enforcement and government agents and their agencies.
7. OrientalPharma will only take responsibility if a delivery had been placed with a valid prescription and the buyer had requested and paid for a 'registered' method of shipping.
8. In the event that the buyer had cashed their payment in but OrientalPharma does not have the item in stock, a full refund will be made to the buyer after a 7 days limit had been reached. If the product requested was available within the 7 days limit, it will be forwarded to the buyer the moment it arrived to the office of OrientalPharma. The buyer is permitted to alter their initial order to their product of choice without any further charges from OrientalPharma after the 7 days limit had been breached.
Please note that the buyer are responsible for the transfer charges and the cost of currency exchanges.
9. Products sent via courier service are NOT recommended and will only be undertaken if the buyer has an account with the courier and has met OrientalPharma disclaimer paperwork requirements. All charges including freight and taxes must be met on the buyer's courier account, including all return costs if the products have to be returned to OrientalPharma.
10. In the event of the products being detained by foreign customs, the buyer must provide evidence to OrientalPharma for their confirmation of importation, i.e. a prescription and copies of communication with customs etc. In such an event the buyer should contact OrientalPharma before committing to any course of action, including the return of any products. If the products are retained by customs, the loss lies with the buyer. In the event that the products are returned by customs, then when the products are received at OrientalPharma they may be reshipped again, or are subject to a product credit note or refund under the conditions in section 13.
11. If the buyer alters an order before the products are shipped then changes can be made, (providing there is no financial difference, otherwise only product credit notes for other goods may be issued). If the buyer wishes to receive a part refund then it is subject to the conditions in section 12.
12. If the buyer wants to stop or change an order after payment has been processed but before the goods have been shipped, it is subject to a 5% charge, or a minimum of $5, whichever is greater.
13. If the buyer wishes to return products for any reason (except under the conditions in section 11). Then providing the products are sent by the buyer within 14 days of receipt and received by OrientalPharma in a good, unopened, resalable condition with an expiry date more than 6 months valid, a credit note for other products may be issued, plus a charge for reshipping. If the buyer requires a full or part refund then a 25% restocking fee (applicable to products and not shipping and handling which is automatically deducted in full) is applicable, or a minimum of $5, whichever is the greater.
14. If OrientalPharma has shipped the wrong products, or products have arrived in a damaged condition due to incorrect packaging. The package and products must be returned to OrientalPharma for inspection (contact OrientalPharma before undertaking any action). If the fault is identified and agreed, OrientalPharma will reship the products a second and final time. Should a refund or part refund be required they are subject to the conditions in section 13.
15. OrientalPharma does not offer medical advice; all information is supplied on an educational basis and does not in anyways replace that of a physician's. All translations are offered on a best effort basis.
16. In the event that an order is seized by your local Customs or FDA or is lost, generally, we will offer a reship at 50% of the original order cost plus shipping on a basis, that you shall provide us with a valid Customs Letter. You are advised to provide an alternate uncompromised address. See our Shipping & Postage section.
17. You understand that their information is kept private and encrypted on our offshore servers. Payment processes and shipping info is completely discreet. All order details data older than 90 days is automatically deleted.
18. OrientalPharma agrees to provides free reships, refund, and other Customer Related Protection only if the Buyers agrees to buy our product via a direct contact with the OrientalPharma, without accessing through other auction website such as eBay, sell.com, iOffer, etc. Customer Related Protection also goes only for products which was bought under it's original price stated in our official website and not for other negotiated prices such as "bulk" sale, or special samples. This however, differs for each order, depending on the assessment for each situation, CustomerRelated Protection shall be provided.
19. OrientalPharma reserved the right to change the price and content of our products or website prior to notice.
20. You agree not to use any of the content, image, affiliates, images, or anything from OrientalPharma for your own use without a written permission from OrientalPharma and/or it's affiliates.
21. Other conditions that are not covered in these Terms and Conditions will be decided by OrientalPharma, and that decision will be final. OrientalPharma terms and conditions are subject to change prior to notice.
